These General Terms and Conditions (“GTC”) apply to the entire business of DABOR Zürich (hereinafter “the Company”).
The products and prices in the online shop are deemed to be an offer. However, this offer is always subject to the condition that dissolves the contract if delivery is not possible or the price is incorrect.
The order is binding for the customer when they complete the ordering process by clicking on the confirmation button.
Once the order has been completed, the customer can no longer change its content. By completing the order, the customer submits to the Company their binding offer to purchase the ordered products.
After the order process has been completed, the customer will receive an e-mail confirming receipt of the order.
This confirmation email constitutes the acceptance of the offer by the Company. A contract between the customer and the Company shall only be concluded with this confirmation e-mail by the Company.
Unless otherwise quoted, all prices are in Swiss francs (CHF).
The Company reserves the right to change prices at any time. The prices valid at the time of the conclusion of the contract shall apply.
The Company offers the customer the following payment options: American Express, Discover, Master Card, Visa, Union Pay, Apple Pay, Google Pay, PayPal.
The Company reserves the right to demand payment in advance at any time without giving reasons.
Offsetting of the invoiced amount against any claim the customer may have against the Company is not permitted.
The Company shall be entitled to refuse delivery or provision of services in the event of default in payment.
Unless otherwise agreed, the place of performance shall be the registered office of the Company. The Company shall fulfil by handing over the ordered products to Swiss Post.
The parties have the express right to call in auxiliary persons to perform their duties under the contract. They shall ensure that the auxiliary person is engaged in compliance with all mandatory statutory provisions and any collective labour agreements.

All orders are packaged with care and shipped from our studio in Switzerland.
For deliveries within Switzerland:
The price shown at checkout is final. No extra fees or hidden costs will apply.
For international deliveries (EU & Rest of the World):
Orders shipped outside Switzerland may be subject to local VAT, import duties and courier clearance fees upon arrival. These charges are determined by the destination country and are the responsibility of the recipient. DABOR Zürich does not collect or cover these fees at checkout.
We recommend checking your local import rules before placing an order.
The customer must ensure that they have provided a valid address for delivery.
When calculating the delivery time, the customer must also include the time required for bank transfers and order processing.
Once an order has been shipped, the customer will receive a shipping confirmation with a tracking code. The customer can use this code to track orders online.
The Company sends all orders by registered post. On delivery, the order must be signed for by the recipient specified on the delivery address. The customer’s shipment is insured until the delivery receipt is confirmed by signature.

If the customer has already received a shipping confirmation email, the jewellery will be in transit to their agreed delivery address, and the Company can no longer redirect it.
Should the customer have changed their mind about a purchase, the Company offers a 14-day exchange and return policy from the date of delivery.
The customer must email the Company with details about the item and the reason for the return at: contact@dabor.ch
Once the Company has received and checked the return, the customer will receive an email confirmation.
The purchase price will be refunded to you within 14 days of us accepting and confirming the return.
The customer is responsible for paying any shipping costs required to return unwanted jewellery. These costs are non-refundable.
NOTE: If you return an international order, any VAT, customs duties or clearance fees paid on import are not refunded by DABOR Zürich. Depending on the destination country, you may be able to apply for a refund directly through the relevant customs authority.
We recommend checking your local import rules before placing an order.
Personalised jewellery or jewellery with custom engravings cannot be exchanged or returned.
To be eligible for a return, the jewellery must be:
If the customer wishes to return an item of jewellery, the stickers must not be removed or torn.
Jewellery purchased on sale or with a gift certificate can be exchanged but not returned.
Should the customer have any issues with the jewellery, they must first contact the Company to clarify the problem.

The Company will do its best to resolve the problem and identify the most appropriate solution. For example, if the Company is unable to repair the jewellery within warranty, a replacement will be provided.
Should the particular jewellery item or collection no longer be available, the Company will refund the cost.
Should the customer wish to make a claim under the warranty guarantee, proof of purchase will be requested.
The statutory provisions concerning the warranty obligation shall apply. Defects in delivered products must be notified to the Company by the customer in writing within 3 days of receipt of the goods.
The Company offers a 2-year warranty on all jewellery from the date of delivery. The customer must keep their purchase receipt, as it provides proof of warranty.
The jewellery is carefully hand-crafted, therefore each piece may contain small differences which are not defects.
The warranty covers defects in materials or workmanship that existed at the time of delivery or are due to a manufacturing fault. For jewellery to be covered by warranty:
Your purchase receipt must show that no more than 2 years have passed since the jewellery was delivered.
Within the 2-year warranty period, DABOR Zürich offers one complimentary re-plating service for your purchased jewellery.
NOTE: The warranty is no longer valid if the jewellery has been altered by the customer or a third party. For example, by carrying out ring resizing or repairs.
The jewellery is carefully hand-crafted, therefore each piece may contain small differences which are not defects.
The warranty covers defects in materials or workmanship that existed at the time of delivery or are due to a manufacturing fault. For jewellery to be covered by warranty:

Upon acceptance of the jewellery delivery by the customer, the protection, insurance and care of the jewellery is the customer’s sole responsibility.
DABOR Zürich offers an atelier re-plating service for pieces purchased from DABOR Zürich, for CHF 38.
If your jewellery is accidentally damaged, we will assess the damage and provide a repair estimate. All shipping costs to and from our base in Zürich are the responsibility of the customer.
Liability for any indirect damage and consequential damage is excluded in full.
Liability for direct damage is limited to the sales price of the product/service. This limitation of liability does not apply to direct damage caused by gross negligence or intent.
The customer is obliged to report any damage to the Company immediately.
Any liability for auxiliary persons is excluded in full.
All rights to the products, services and any trademarks are vested in the Company or it is authorised to use them by the owner.
Neither these General Terms and Conditions nor any individual agreements pertaining thereto shall include the transfer of any intellectual property rights, unless this is explicitly mentioned.
Furthermore, any further use, publication or making available of information, images, texts or anything else which the customer receives in connection with these provisions is prohibited unless explicitly authorised by the Company.
If the customer uses content, texts or pictorial material in connection with the Company in which third parties have a property right, the customer must ensure that no property rights of third parties are infringed.
These General Terms and Conditions may be amended by the Company at any time.
The new version shall come into force 30 (thirty) days after the Company has posted it on the website (www.dabor.ch).
The version of the GTC in force at the time of the conclusion of the contract shall apply to the customer. Unless the customer has agreed to a newer version of the GTC.
These GTC take precedence over all older provisions and contracts. Only provisions from individual contracts which specify the provisions of these GTC shall take precedence over these GTC.
Should a provision of this contract or an annex thereto be or become invalid, this shall not affect the validity of the remainder of the contract. The contracting parties shall replace the invalid provision by a valid provision which comes as close as possible to the intended economic purpose of the invalid provision. The same shall apply to any loopholes in the contract.
Both parties, as well as their auxiliary persons, undertake to treat all information submitted or acquired in connection with the services as confidential. This obligation shall remain in force even after the termination of the contract.
If the timely performance by the Company, its suppliers or third parties involved becomes impossible as a result of force majeure, such as natural disasters, earthquakes, volcanic eruptions, avalanches, thunderstorms, storms, wars, riots, civil wars, revolutions and uprisings, terrorism, sabotage, strikes, nuclear accidents or reactor damage, the Company shall be released from the performance of the affected obligations for the duration of the force majeure and a reasonable start-up period after its end. If the force majeure lasts longer than 30 (thirty) days, the Company may withdraw from the contract. The Company shall refund to the customer in full any payment already made.
Any further claims, in particular claims for damages as a result of vis major, are excluded.
These GTC are subject to Swiss law. Unless mandatory statutory provisions prevail, the court at the registered office of the Company shall have jurisdiction. The Company is free to bring an action at the defendant’s place of business. The United Nations Convention on Contracts for the International Sale of Goods (SR 0.221.211.1) is explicitly excluded.
For each piece sold, DABOR Zürich donates 5% of the purchase price to selected charities in Poland that work to reduce social isolation and poverty.
